Entry preclearance, granting entry approval for foreigners entering Vietnam under international treaties to which Vietnam is a signatory but having not yet had a commercial presence or partners in Vietnam

Submit your application online via the electronic transaction page on the Immigration Portal or the National Public Service Portal or the Public Service Portal of the Ministry of Public Security .
Step 1: Foreigners access the Immigration Portal of Vietnam Immigration Department (domain name in Vietnamese: “https: //www.xuatnhapcanh.gov.vn", in English "https://www.immigration.gov.vn"), go to the electronic transaction page or access the National Public Service Portal or the Public Service Portal of the Ministry of Public Security to fill in information on electronic visa application, upload portrait photo and passport bio-data page, attach proof of being subject to international treaties to which Vietnam is a signatory but having not yet had a commercial presence or partners in Vietnam. After performing this step, the foreigner will be issued an electronic dossier code by the system.

Step 2 : Receive the result
+ Foreigners use the electronic dossier code to check the status at the electronic transaction page or the National Public Service Portal or the Public Service Portal of the Ministry of Public Security; In case of being granted entry approval, use the electronic dossier code to print the official letter replying to the request for entry approval for foreigners or the official letter replying to the visa application at the international border gate.
+ Time: from Monday to Friday (except New Year’s day and public holidays)
+ Within 02 working days from the date of receipt of a complete dossier as prescribed, the Immigration Department shall transfer to the agency assigned by the Government to take the prime responsibility for implementing the international treaty.
+ Within 03 working days from the date of receipt of the foreigner's visa application from the Immigration Department, the agency assigned by the Government to take the prime responsibility for implementing the treaty shall:
(1) If a foreigner is subject to the provisions of an international treaty to which Vietnam is a signatory in the field of state management of the leading agency, he/she shall directly submit a written request for a visa to the Vietnam Immigration Department according to regulations; if the foreigner is not subject to the provisions of an international treaty to which Vietnam is a signatory, shall reply to the Immigration Department to notify the foreigner.
(2) Or transfer the visa application to the ministry or ministerial-level agency in charge of state management in that field, in case the foreigner belong to the provisions of an international treaty to which Vietnam is a signatory but is not subject to the field of state management of the host agency. Within 02 working days from the date of receiving the visa application from the foreigner, the ministry or ministerial-level agency shall send a written request for visa issuance to the Immigration Department according to regulations.
+ Within 03 working days from the date of receiving the written request for visa issuance, the Immigration Department considers, process and reply.

+ 4cm x 6cm portrait photo; photo of passport biodata page uploaded to the electronic transaction page or the National Public Service Portal or the Public Service Portal of the Ministry of Public Security in accordance with the regulation.
+ Proof of being subject to international treaties to which Vietnam is a signatory but having not yet had a commercial presence or partners in Vietnam, uploaded on the electronic transaction page or the National Public Service Portal or Public Service Portal of the Ministry of Public Security in accordance with the regulations.
+ Foreigners who are subject to the provisions of international treaties to which Vietnam is a signatory but do not yet have a commercial presence or partners in Vietnam.
+ Foreigners who do not fall into the cases that are not allowed to enter the country specified in Article 21 of the Law on Foreigners’ entry into, exit from, transit through and residence in Vietnam.
+ Foreigners who have papers proving that they are subject to the provisions of an international treaty to which Vietnam is a signatory but having not yet had a commercial presence or partners in Vietnam may be consularly legalized, unless otherwise exempted according to the provisions of Vietnamese law or international treaties to which Vietnam is a signatory.
+ The Law on Foreigners’ entry into, exit from, transit through and residence in Vietnam (Law No. 47/2014/QH13 dated June 16, 2014); was amended and supplemented in 2019 (Law No. 51/2019/QH14 dated November 25, 2019).
+ Decree No. 75/2020/ND-CP dated July 1, 2020 of the Government detailing a number of articles of the Law amending and supplementing a number of articles of the Law on Foreigners’ entry into, exit from, transit through and residence in Vietnam.
+ Circular No. 04/2015/TT-BCA dated January 5, 2015 of the Ministry of Public Security stipulating the form of documents related to the entry, exit, transit and residence of foreigners in Vietnam.
